Please review these Terms of Service carefully before creating an account or publishing smart links on Smart Link Flow (smartlinkflow.com).
Smart Link Flow is an independent software utility that generates responsive landing pages, deep-links fans to streaming services, collects voluntary email signups, and relays marketing telemetry. We are not affiliated with, sponsored by, or endorsed by Spotify, Apple Music, YouTube, Deezer, TikTok, Meta (Facebook/Instagram), or Google.
1 Agreement to Terms
These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "Creator", "you") and Smart Link Flow ("we", "us", "our"), governing your access to and use of the website located at smartlinkflow.com, including all related subdomains, web applications, APIs, and generated smart link landing pages (collectively, the "Platform" or "Service").
By registering an account, creating or customizing smart links, accessing the studio dashboard, or navigating any smart link hosted on our domain, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.
2 Service Scope & Software Utility Nature
Smart Link Flow provides automated software tools designed for musical artists, record labels, talent managers, and content creators. The Service allows Users to:
- Generate responsive, customized landing pages and bio hubs for music releases, albums, podcasts, and merchandise.
- Utilize URI schemes and deep links to assist visitors in opening native mobile applications (e.g., Spotify, Apple Music, YouTube).
- Configure client-side and server-side tracking pixels (Meta Pixel, Meta Conversions API / CAPI, TikTok Pixel, Google Ads / Google Tag) for ad attribution and conversion analytics.
- Capture voluntary fan email subscriptions for artist newsletter exports.
Smart Link Flow operates strictly as a neutral technical intermediary and software utility. We do not act as a record label, music distributor, publisher, advertising agency, talent representation, or digital streaming provider (DSP). We exercise no editorial control over the music, artwork, or destinations chosen by Users.
3 Third-Party Platform Disclaimer & Trademark Notice
Non-Affiliation Disclaimer:
Smart Link Flow is completely independent and is NOT affiliated, endorsed, sponsored, authorized, or partnered with Spotify AB, Apple Inc. (Apple Music, iTunes), Google LLC / Alphabet Inc. (YouTube, YouTube Music, Google Ads), Deezer SA, Amazon.com Inc. (Amazon Music), TikTok Pte. Ltd. / ByteDance Ltd., Meta Platforms, Inc. (Facebook, Instagram), or any other digital streaming platform or advertising network.
All product names, logos, brand trademarks, service marks, and registered trademarks displayed on this website or within generated landing pages remain the exclusive property of their respective trademark holders. The display of DSP logos (such as Spotify or Apple Music icons) is conducted solely for nominative fair use to identify the external destination platforms chosen by the creator.
4 User Content, Intellectual Property & Prohibited Conduct
You retain ownership of all materials, audio snippet previews, artwork, cover images, artist names, release titles, and destination links you upload or configure ("User Content").
Your Representations & Warranties:
By creating a smart link or uploading content, you represent and warrant that:
- You own or possess all necessary rights, licenses, sync rights, master recording rights, and permissions to publish and promote the User Content and destination URLs.
- Your User Content does not infringe upon, misappropriate, or violate any copyright, trademark, patent, trade secret, privacy right, or intellectual property right of any third party.
- Your smart link destination URLs do not lead to malicious software, spyware, phishing scams, deceptive redirects, unlawful financial schemes, or fraudulent downloads.
Absolute Prohibitions & Takedown Rights:
You may not use Smart Link Flow to distribute or promote: (a) pirated music or unauthorized bootlegs; (b) sexually explicit, pornographic, or obscene material; (c) defamatory, harassing, hateful, or violent extremist content; or (d) deceptive URL redirection schemes.
Smart Link Flow reserves the unconditional right to suspend, terminate, or delete any smart link, draft release, or user account immediately, with or without notice, upon receiving a copyright infringement notice (including DMCA notices) or upon detecting a violation of these Terms.
5 Ad Tracking Telemetry, Pixels & Indemnification
Smart Link Flow enables creators to input third-party pixel IDs and API tokens (such as Meta Pixel Dataset IDs, Meta Conversions API Access Tokens, TikTok Pixel IDs, and Google Ads Conversion IDs).
Creator Responsibility for Advertising & Privacy Compliance:
- You are solely responsible for ensuring that your advertising campaigns, ad copy, targeting practices, and data collection comply with all applicable advertising network policies (including Meta Advertising Standards, TikTok Advertising Policies, and Google Ads Policies) and data privacy laws (such as GDPR, UK GDPR, CCPA/CPRA, and the ePrivacy Directive).
- Smart Link Flow acts strictly as a technical mechanism to transmit conversion signals and deduplication identifiers (
event_id) configured by you. - Zero Ad Liability: Smart Link Flow and its operators bear NO liability for rejected ad campaigns, restricted or banned ad manager accounts, conversion count discrepancies, attribution discrepancies, iOS privacy opt-outs, or algorithm changes by advertising platforms.
You agree to defend, indemnify, and hold harmless Smart Link Flow, its operators, officers, and service providers against any regulatory fines, claims, penalties, or damages resulting from your failure to comply with advertising rules or privacy laws.
6 Fan Email Capture & Dual Data Roles
When smart link visitors submit their email address via the built-in "Never Miss a Drop" fan capture form:
- The Creator is the Data Controller with respect to the fan email addresses collected for their release.
- Smart Link Flow is the Data Processor providing database storage and CSV export functionality to the Creator.
- Creators are solely responsible for obtaining valid legal consent under applicable laws (e.g. CAN-SPAM, GDPR, CASL) before sending marketing emails, newsletters, or promotional campaigns to captured fan contacts.
7 Disclaimer of Warranties ("AS IS" & "AS AVAILABLE")
Please read this section carefully as it limits our warranties.
THE PLATFORM, HOSTED SMART LINKS, DEEP-LINKING URI PROTOCOLS, AUDIO SNIPPET PLAYERS, TELEMETRY DISPATCHERS, AND DASHBOARDS ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY.
WE DO NOT GUARANTEE THAT: (A) THE SERVICE WILL BE COMPLETELY ERROR-FREE, UNINTERRUPTED, OR FREE OF BROWSER INCOMPATIBILITIES; (B) NATIVE MOBILE URI SCHEMES WILL OPEN PROMPTLY IN ALL IN-APP WEBVIEWS OR DEVICE OPERATING SYSTEMS; (C) CONVERSION PIXELS WILL RECORD 100% OF AD CONVERSIONS IN ENVIRONMENTS WHERE AD-BLOCKERS ARE ACTIVE; OR (D) USING OUR SERVICE WILL RESULT IN STREAMING GROWTH, CHART PLACEMENT, OR FINANCIAL REVENUE.
8 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SMART LINK FLOW, ITS OPERATORS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOST ADVERTISING SPEND, UNPRODUCTIVE CAMPAIGN BUDGET, OR REJECTED ADS;
- LOST STREAMING ROYALTIES, REVENUE, PROFITS, OR COMMERCIAL OPPORTUNITIES;
- LOST FAN SUBSCRIBER DATA, SYSTEM DOWNTIME, OR INABILITY TO ACCESS THE SERVICE;
- ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT OR TRANSMISSIONS.
IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF SMART LINK FLOW SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO SMART LINK FLOW IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR FIFTY U.S. DOLLARS ($50.00 USD) IF YOU USE THE FREE TIER).
9 Modifications & Termination
We reserve the right to modify, update, or replace these Terms at any time. When modifications occur, we will update the "Last Updated" date at the top of this document. Your continued use of the Platform following the posting of changes constitutes acceptance of the revised Terms.
We may terminate or suspend your account, delete your links, or block access to the Service at our sole discretion, without prior notice, for conduct that violates these Terms or harms other users, DSPs, ad networks, or the integrity of Smart Link Flow.
